  • News in the field of employment relationships

The Ministry of Labour and Social Protection has issued Order no. 585/2021 for the amendment and completion of the individual employment contract template, provided in the annex to the Order no 64/2004 (the ”Order 585/2021”).

Order 585/2021 was published in the Romanian Official Gazette no. 712 of 19 July 2021 and entered into force on the same date.

Order 585/2021 provides for two new amendments concerning the individual employment contract template, as follows:

  • Letter F. “Job responsibilities” has been amended and mentions that the job responsibilities will be detailed under the job description annexed to the individual employment contract, with the exception of microenterprises with up to 9 employees, which will provide a short characterization/description of the activity.

An alignment of the individual employment contract template with the recent legislative changes concerning microenterprises (which can be consulted here) is envisaged. 

  • Letter M. “General rights and obligations of the parties”, point 4 (main obligations of the employer) has been amended by adding a new provision stating the employer’s obligation to inform the employee about the obligation to adhere to a private pension fund.
